<p class="MsoNormal" style="text-align: justify;"><span style="font-family: arial;">India commands the largest share
of the world's shipbreaking industry but has justifiably been criticised for
environmental degradation and lax compliance towards worker safety and health
issues. This is meant to change with the introduction of legislation to give
effect to the Hong Kong International Convention for the Safe and
Environmentally Sound Recycling of Ships, 2009, (Convention). The Convention is
aimed at ensuring that ship recycling does not pose unnecessary risk to the
environment or to human health and safety.</span></p>
<p class="MsoNormal" style="text-align: justify;"><b><span style="font-family: arial;"><br /></span></b></p><p class="MsoNormal" style="text-align: justify;"><b><span style="font-family: arial;">Hong Kong Convention<o:p></o:p></span></b></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-family: arial;">The Convention mandates the
procedure to be followed for survey and certification of ships to be recycled
as well as for the authorisation of ship-recycling facilities. It requires
member states to prohibit and/or restrict the installation and use of certain
hazardous materials on ships flying their flags or whilst in their ports,
shipyards, ship repair yards or offshore terminals. It contemplates inspection
of ships for the purpose of verifying that there is on board either an
International Certificate on Inventory of Hazardous Materials or an
International Ready for Recycling Certificate. It obliges states to frame laws
imposing sanctions on ships and ship-recycling facilities contravening the
Convention. The regulations appended to the Convention also list the various
requirements which need to be met such as preparation of a ship-recycling
facility plan and presence of an inventory of hazardous materials on board the
ships.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-family: arial;">India formerly acceded to the
Convention in November 2019. The Convention has now been ratified by 15 IMO
member states but is yet to formally come into force. This is because ratifying
member states must represent 40% of world merchant shipping by gross tonnage,
and must have a combined maximum annual ship recycling volume of not less than
3% of their combined gross tonnage for the past 10 years.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-family: arial;">That means further tonnage and
recycling volumes are needed before the convention can enter into force, which
would require ratification by other major ship recycling nations like
Bangladesh, China, Pakistan and Turkey.<o:p></o:p></span></p>
<p class="MsoNormal" style="text-align: justify;"><o:p><span style="font-family: arial;"> </span></o:p></p>
<p class="MsoNormal" style="text-align: justify;"><b><span style="font-family: arial;">Indian Background<o:p></o:p></span></b></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-family: arial;">In the Indian context,
environmental concerns against shipbreaking were publicly raised for the first
time when two heavily toxic French vessels were sent to India for dismantling.
The Supreme Court recognised that precautionary and polluter-pay principles
were part of Indian law but permitted the Blue Lady to be dismantled in Alang.
However, the Supreme Court directed the authorities to frame legislation for
environmentally safe dismantling of ships. A ship breaking code was accordingly
formulated in 2013.<o:p></o:p></span></p>
<p class="MsoNormal" style="text-align: justify;"><o:p><span style="font-family: arial;"> </span></o:p></p>
<p class="MsoNormal" style="text-align: justify;"><b><span style="font-family: arial;">Shipbreaking Code (Code)<o:p></o:p></span></b></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-family: arial;">The Code divides the shipbreaking
process into three broad stages- anchoring, beaching and ship recycling. The
Code provides comprehensive regulations specific to each of these stages. There
is a requirement of a Ship Recycling Facility Management Plan (SRFMP) and the
Ship Specific Recycling Plan (SSRP) to be provided by the recycler to get
permission for beaching. Along with the SSRP, there is also the requirement of
producing a disposal plan as well as gas-free and fit-for-work certification. <o:p></o:p></span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-family: arial;">The Code permits the authorities
to deny permission of entry or beaching to vessels not fulfilling the
requirements of the Code which can be traced back to the Basel Convention.<o:p></o:p></span></p>
<p class="MsoNormal" style="text-align: justify;"><b><o:p><span style="font-family: arial;"> </span></o:p></b></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-family: arial;"><b>Worker Safety:</b> Recognising
that most workers employed in shipbreaking yards are illiterate, the Code
requires the use of signs and symbols for warning workers against hazards. The
Code also regulates the terms of employment of labourers by importing
provisions from various labour welfare legislations. For example, it requires
workers engaged in breaking/cutting ships to be registered either under
Employees State Insurance Corporation or Workmen Compensation Act. Similarly,
it imports the Factories Act to provide maximum weekly and daily hours of work,
holidays and wages for overtime work. The Code also requires the Labour
Department to ensure compliance with legislation stipulating minimum wages for
workers.<o:p></o:p></span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-family: arial;">The handling of hazardous
material like asbestos waste and asbestos containing material has been separately
regulated by the Code.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-family: arial;">Prescribes stringent procedures
at each stage of the demolition process, requiring multiple certificates
(Certificate of Registry, non-encumbrance certificate, NOC's from various
authorities) to be obtained and other compliances. Permission from different
authorities like the State Maritime Board/Port Authority, the State Pollution
Control Board, Petroleum and Explosives Safety Organisation, Atomic Energy
Regulatory Board, Customs Department, are required depending on the type of
ship. Verification of documents, physical inspection of the vessel and
certification from different authorities is contemplated before permission to
beach is granted.</span></p>
<p class="MsoNormal" style="text-align: justify;"><o:p><span style="font-family: arial;"> </span></o:p></p>
<p class="MsoNormal" style="text-align: justify;"><b><span style="font-family: arial;">Recycling of Ships Bill, 2019
(Bill)<o:p></o:p></span></b></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-family: arial;">A new Bill has been approved by
the Union Cabinet in November 2019 and is now awaiting legislative approval by
the Lok Sabha (Lower House of Parliament). It is unclear whether the Bill
repeals the Code, given that the Code has more stringent provisions for
beaching than the Bill.<o:p></o:p></span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-family: arial;">The Bill substantially
incorporates the provisions of the Convention and covers within its ambit:</span></p>

<p class="MsoNormal" style="text-align: justify;"><span style="font-family: arial;">A ship in India can only be broken
at an authorised ship recycling facility after being certified as ready for
recycling. </span><span style="font-family: arial;"> </span><span style="font-family: arial;">The Bill, like the
Convention, stipulates the procedure to be followed for survey and
certification of ships as well as for the authorisation of ship-recycling
facilities. The Bill restricts the use or installation of hazardous material on
the ship, prohibited by the Central Government. The owner of every new ship is
required to procure a 'certificate on inventory of hazardous materials' for
each ship- existing ships not in possession of such certificate must obtain one
within five years. Furthermore, the Bill provides for inspection of a ship
recycling facility by the competent authority and mandates preparation of a
ship-specific recycling plan by the recycling facility, an inventory of
hazardous materials and requirement to report to the competent authority.
Similar to the Convention, the Bill stipulates safe and environmentally sound
management of hazardous waste and worker safety and training. Contravention of
the provisions of the Bill, entail penalties upon both the ship owner and the
recycling facility.</span></p>
<p class="MsoNormal" style="text-align: justify;"><o:p><span style="font-family: arial;"> </span></o:p></p>
<p class="MsoNormal" style="text-align: justify;"><b><span style="font-family: arial;">Lacunae in the Bill<o:p></o:p></span></b></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-family: arial;">The Convention leaves it to
member states to employ a safe and sound method of shipbreaking. In India the
method used, viz, beaching, is not environment and worker friendly. A major
flaw in the Bill is that it neither specifies a method of ship recycling nor
bans the beaching process. In contrast, the Code classifies the demolition
process into stages and regulates beaching.<o:p></o:p></span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-family: arial;">The requirement of 'prior
informed consent' for the export of hazardous substances, which is a
requirement of the Basel Convention and of the Code, finds no mention in the
Bill.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-family: arial;">The Bill, like the Convention,
exempts from its ambit war ships or ships owned or operated by the Government
and used for Government non-commercial purposes and ships that are less than
five hundred gross tonnage. This omission is significant, given that warships
and naval vessels have a large source of hazardous materials like asbestos and
chemicals like mercury, which should have been regulated. Interestingly, the
Code does not grant such an exemption to these vessels and instead categorises
them as ships of 'special concern'.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-family: arial;">The Convention, as well as the
Bill, make clear that the responsibility of a ship owner is limited to getting
clean certificates from the flag state. No responsibility for clean-up, is cast
on the ship owner.</span></p>
<p class="MsoNormal" style="text-align: justify;"><o:p><span style="font-family: arial;"> </span></o:p><span style="font-family: arial;">Another drawback of the Bill is
that instead of comprehensively providing for environment and worker safety, it
delegates the making of such regulations and guidelines to other authorities,
and leaves it to the ship recycling facility to comply with applicable regulations.
This delegation makes the successful outcome of the objectives of the Bill
uncertain and dependent on executive action. This is in marked contrast to the
Convention and the Code both of which exhaustively provide for environment
protection and worker safety.</span></p>
<p class="MsoNormal" style="text-align: justify;"><o:p><span style="font-family: arial;"> </span></o:p><span style="font-family: arial;">Although the Bill provides for
compliance with the Factories Act, 1948, it is silent on the applicability of
other labour welfare legislation, such as the Inter-State Migrant Workmen Act
and the Trade Unions Act. The rights conferred on workman under these statutes
should have been imported in the Bill. Significantly, there is no prohibition
on the employment of minors and adolescents, considering that ship breaking is
recognized as a hazardous industry and their employment in hazardous places of
work is prohibited.</span></p>
<p class="MsoNormal" style="text-align: justify;"><o:p><span style="font-family: arial;"> </span></o:p></p>
<p class="MsoNormal" style="text-align: justify;"><b><span style="font-family: arial;">Conclusion<o:p></o:p></span></b></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-family: arial;">The Bill is a missed opportunity
to address problems specific to the Indian ship breaking industry. The
legislation should have drawn on the experience and difficulties faced in the
implementation of the Code and devised a more robust legal framework for ship
demolition. The Bill instead eases the more stringent regulatory framework
prescribed by the Code. The ultimate objective, of ensuring that the Indian
ship recycling industry embraces truly green recycling practices, remains for
the time being an unfulfilled aspiration.<o:p></o:p></span></p>

media, worker Md. Khalil (45) got injured on April 28 at an unauthorised
shipbreaking yard recently opened by lawmaker Didarul Alam. Khalil’s leg broke
after a hatch cover fell on him while dismantling the vessel BERGE EIGER, owned
by shipping company Berge Bulk. The worker was transferred to the Dhaka
Hospital due to the severity of the injury. <o:p></o:p></span></div>

place during an illegal night shift at Jumuna Ship Breakers yard. Abdul Halim
(24) was hit by an iron piece in the stomach while cutting the vessel STELLAR
KNIGHT, owned by South Korean Polaris Shipping. It took a couple of hours for
the worker to be transported to the nearest hospital.<o:p></o:p></span></div>

Greek ship owners sold the most ships to South Asian yards, closely followed by
Singaporean and South Korean owners. South Korean company Polaris Shipping sold
three vessels to Bangladesh for dirty and dangerous breaking. The ship owner
hit the headlines in June for the scuttling of the ore carrier STELLAR BANNER
off the coast of Brazil.<o:p></o:p></span></div>

halt the import of a highly toxic offshore unit that had illegally departed
from Indonesia. The Floating Storage and Offloading (FSO) tanker J. NAT left
Indonesian waters even though local activists warned Indonesian authorities
about the toxicity of the vessel. Following our actions and local media
reports, the government of Bangladesh directed all departments concerned not to
allow the ship to enter Bangladeshi territory. Maritime databases seem to
indicate that the vessel reversed course and changed name to RADIANT. However,
its current whereabouts are unknown. <o:p></o:p></span></div>

sold to South Asia this quarter changed flag to the registries of Comoros,
Palau and St. Kitts and Nevis just weeks before hitting the beach. These flags
are not typically used during the operational life of ships and offer ‘last
voyage registration’ discounts. They are particularly popular with the
middlemen that purchase vessels cash from ship owners, and are grey- and
black-listed due to their poor implementation of international maritime law.
The high number of flag changes at end-of-life seriously compromises the effectiveness
of legislation based on flag state jurisdiction only, such as the European
Union (EU) Ship Recycling Regulation.<o:p></o:p></span></div>

from the Northwest of Bangladesh, have been left to starve. This unprecedented
emergency situation led us to raise financial support to distribute, in
partnership with our member organisation OSHE, food and personal protective
equipment items to 130 of the most deprived shipbreaking workers’ families in
Sitakunda. <o:p></o:p></span></div>

College Hospital. The condition of one of them is extremely critical. Local

KELANA 4 was beached at Mahinur Ship Breaking six months ago. It was owned by
Malaysian shipping company AET Tankers, a wholly owned subsidiary of MISC, the
leading Malaysian energy logistics company listed on the Malaysia stock
exchange. In 2018, AET Tankers sold four vessels for scrapping on the beaches
of South Asia. Three ended up in Bangladesh; one was beached in India. <o:p></o:p></span></div>

was swapped to that of Comoros. These are clear indicators that the vessel was
brought to the beaching yard with the help of a scrap-dealer known as cash
buyer. The use of black- and grey-listed flags, such as Comoros, Palau and St
Kitts and Nevis, as well as anonymous post-box companies to register the ships,
renders it very difficult for authorities to trace and hold ship owners liable
for illicit business practices that cause the loss of life, injuries and
irreparable damage to the environment.<o:p></o:p></span></div>

on the BUNGA KELANA 4 follows another recent tragic event that took place in
February, when two workers were killed by a fire on board a tanker owned by
Greek Polembros Shipping. In the last ten years, hundreds of workers have lost
their lives and suffered severe injuries due to dirty and dangerous
shipbreaking practices in Bangladesh. Many more suffer from exposure to toxic
fumes and materials that are embedded within the ships’ structures. Breaking
apart ships on tidal beaches also causes irreparable damage to the environment.
Only yesterday it was revealed that another shipbreaking company, BBC Ship
Breaking, had been given the permission by local authorities to wipe out a
protected mangrove forest in order to establish a new yard. Following the
filing of a complaint by Platform member organisation BELA, the High Court
imposed a six months’ stay on the lease contract and have asked the local
authorities to explain why they blatantly ignore national forest protection
laws. In 2009, 14.000 mangrove trees were illegally cut to expand the
shipbreaking activities in Chittagong.<o:p></o:p></span></div>

should act as a wake-up call for the financiers and customers of shipping to
demand recycling practices off the beach and in line with the standards set by

Norway’s largest private pension fund, followed suit and blacklisted the same
companies. In January, KLP also blacklisted Nordic American Tankers (NAT)
following the sale of ten oil tankers for dirty and dangerous scrapping on
beaching yards in South Asia. The Bermuda-registered company, controlled from
Norway by Herbjørn Hanson, was firstly confronted by KLP and criticised by
Norwegian press for having sold eight ships for scrapping to South Asia in
2018, ensuring NAT a 80 million dollar scrapping revenue. Five vessels ended up
in Chittagong, Bangladesh; three ended up in Alang, India. The sale of two
additional vessels to Bangladeshi yards with terrible accident records prompted
KLP to blacklist NAT earlier this year.<o:p></o:p></span></div>

assessments, done by the classification society DNV GL, identified several
areas where the yards do not meet the requirements for clean and safe ship

9270737) caught fire, this time injuring seven workers, three of which are in a
critical condition.</span></div>

58 on the 1st of November 2016. Since then, there have been at least five more
fires caused by unsafe cutting operations. Difficult access for firefighters, a
severe lack of ambulances and no hospital in the close vicinity of the yards
aggravate the conditions, as reported by trade unions. <o:p></o:p></span></div>

authorities imposed a ban on the import of tankers in addition to a ban on
cutting operations. The ban on import was however lifted in April 2018 after 18
months’ freeze. Due to the use of the low-cost method of beaching and the
favorable steel market conditions, the Gadani yards offer high prices for
end-of-life ships, and soon 22 tankers were waiting for the cutting ban to also
be repealed. One local breaker nonetheless started scrapping the VLCC ADA
before the authorities lifted the cutting ban, and a fire erupted onboard the
tanker in July. Despite the accident, and the fact that few measures had been
put in place to ensure safe working conditions, the government issued cutting
permissions in late August, putting the life of the workers in danger and
prompting the import of additional vessels. <o:p></o:p></span></div>

Platform. “We are concerned over the political clout ship owners seem to enjoy:
Greek owners alone are responsible for 1/3 of the ships that are currently
beached in Gadani, yet Greece is pushing hard to undermine European laws aimed
at improving practices globally”, she adds. <o:p></o:p></span></div>

owners and yard operators fail to take necessary precautions, but also that the
Balochistan EPA acted negligently when approving the work to start. Fires occur
when vessels that are not properly cleaned from highly inflammable residual oil
are cut with blowtorches. <o:p></o:p></span></div>

with an end-of-year review of developments in the ship recycling industry and
with some thoughts on what we may expect to see in the new year. In preparing
this year’s review I felt that, before setting out my expectations for 2019, it
would be appropriate first to recall the expectations I had for 2018 in my
article of January 7 and to compare these with what actually took place in the
year.<o:p></o:p></span></div>

most probably ratify the Convention and bring much closer its entry into force.
With regard to the European Union and its Ship Recycling Regulation I had
suggested that, if the European Commission continued to be ambivalent about
approving yards in South Asia, they would have a lot of sleepless nights because
of the lack of ship recycling capacity for the practical needs of European
shipowners. At that time, I had also wondered about the prospects of China’s
ship recycling industry which had been experiencing a dramatic decline. <o:p></o:p></span></div>
<div class="MsoNormal" style="line-height: 130%; margin-bottom: .0001pt; margin-bottom: 0in; text-align: justify;">

as disappointing as were some of the developments: <o:p></o:p></span></div>

was deposited to the Secretary General of the IMO during 2018. The Convention
still has only six contracting States (Belgium, Congo, Denmark, France, Norway
and Panama) whose combined fleet constitutes 21 percent of the world’s tonnage
and 0.04 percent of the world’s recycling capacity (<span style="color: blue;">compared to the entry into
force requirement of a minimum of 15 States with no less than 40 percent of the
world’s tonnage and a proportionate recycling capacity</span>).<o:p></o:p></span></div>
<div class="MsoNormal" style="line-height: 130%; margin-bottom: .0001pt; margin-bottom: 0in; text-align: justify;">

<span style="font-family: Verdana, sans-serif;">(2) The European Commission does not appear to have
had any sleepless nights, as they seem to be at peace knowing that from
December 31, 2018 European flagged ships will have to be recycled in one of
only three three yards that the Commission has managed to approve following the
receipt of numerous applications more than three years ago, or in a yard
located in the E.U. Two of the approved yards are in Turkey and one in the
U.S., which as anyone who knows anything will confirm that the U.S. is not a
realistic destination for the recycling of non-U.S. ships. A further 22
facilities in the latest version of the European List are E.U.-based and
luckily for them do not require the Commission’s approval. According to common
knowledge, these facilities are not known for the recycling of ocean-going
ships, and in their busiest year since 2013 they recycled all together only
65,000 LDT, presumably of coastal and inland waterways tonnage.<o:p></o:p></span></div>
<div class="MsoNormal" style="line-height: 130%; margin-bottom: .0001pt; margin-bottom: 0in; text-align: justify;">

<span style="font-family: Verdana, sans-serif;">(3) The Chinese government, having subsidized heavily
its ship recycling industry for the last three to four years, suddenly decided
in April to ban the import of ships for recycling from the end of the year,
this way removing at a stroke of a pen from the international market around one
quarter of the world’s ship recycling capacity and an even larger share of the
so called green ship recycling capacity.<o:p></o:p></span></div>

<span style="font-family: Verdana, sans-serif;">(4) In March, a Dutch court, in the first successful
prosecution of a shipping company under the European Regulation on Shipments of
Waste, found guilty the Seatrade Group and issued heavy fines and a 12-month
professional ban against two directors for having sent four ships for recycling
to Bangladesh, India and Turkey in 2012 without permission. The case, which is
being appealed, sent shockwaves to the shipping industry.<span style="mso-spacerun: yes;"> </span><o:p></o:p></span></div>

Thereafter the usual NGO politics ensued with the result that Greenpeace issued
a public apology to the Shipbreaking Platform and also the promise “to urgently
adopt an end-of-life ship policy, drafted with the help of the Shipbreaking
Platform, to help ensure such errors do not occur in future.” I believe this
was a wasted opportunity to take an ethical stance and show leadership. <o:p></o:p></span></div>

GMS to Indian yards in 2018 were recycled in accordance with the requirements
of Hong Kong Convention, with Ship Recycling Plans and with Inventories of
Hazardous Materials developed by GMS’s qualified experts. <o:p></o:p></span></div>

decision on the Seatrade case and with the imminent implementation of the
European Regulation on Ship Recycling, more shipowners started paying attention
to the challenges of ship recycling. During the year, GMS facilitated at least
seven visits to India for shipowners who wanted to see for themselves the yards
and the improvements that have taken place in Alang. Also, through the year
shipowners and shipowners’ associations have campaigned for the Hong Kong
Convention’s entry into force (this being the rather unusual situation of the
regulated campaigning for regulation). <o:p></o:p></span></div>

Indian and six Turkish yards whose applications are at various stages of review
by the European Commission and its consultants. A first major juncture in 2019
will be around spring time when the European Commission is expected to announce
whether the first two Indian yards that were audited last autumn are approved
and included in the European List, or not. If they are approved, more yards in
India will work hard to also gain approval, and in doing so will make available
more real recycling capacity for shipowners of E.U. flagged ships. <o:p></o:p></span></div>

turned down, or the Commission’s decision is postponed over convenient
technicalities, then owners of end-of-life E.U. flagged ships will have little
option but to flag-out. This is because the one thing I can predict with
certainty is that the idea promoted by Brussels, that the ocean-going fleet of
Europe can be recycled in European Union yards, will not materialize.
Therefore, looking ahead, there are two European scenarios for 2019: a
successful and effective implementation of the European Regulation or a failed
implementation that leads to evasion. <o:p></o:p></span></div>

successfully in 2019 it will disseminate its underlying technical standards
(which are those of Hong Kong Convention) to the wider world and in this way
will support the global acceptance of the Convention’s standards. On the other
hand, a failure of the European Regulation could very well result in accelerated
ratifications of the Hong Kong Convention by European countries who will be
justifiably pressured by their own shipping industries. <o:p></o:p></span></div>

secured ratification through its Parliament, as also has Turkey. It is also
understood that the Netherlands, Estonia and possibly Italy are making progress
towards ratification. Japan’s ratification is expected very soon, and no doubt
other countries may well be getting close to ratifying the Hong Kong
Convention. Furthermore, open registers, such as Liberia and Marshall Islands,
can easily ratify the Hong Kong Convention, and I believe that they will do so
as soon as the shipping industry confirms that the large tonnage of these
registers is not going to hinder the recycling capacity condition of the Hong
Kong Convention’s entry into force from being satisfied. <o:p></o:p></span></div>

company five hours to free the man, who ended up with a broken lower leg and

vast majority of ship owners do not take responsible decisions when getting rid
of their old ships. Instead, they sell their vessel to scrap dealers known as
cash buyers. These companies, such as GMS, Wirana and Best Oasis, offer ship
owners the highest price – in cash – for end-of-life vessels. They will manage
the ship on its last voyage, as well as rename and reflag it, often to the
worst performing flags in the world as part of their business model.
Registering also the ships under anonymous post box companies, it becomes
challenging for authorities to hold cash buyers accountable for their illicit
business practices. Ship owners, on the other hand, will claim that their
responsibility ended once the deal was concluded with the cash buyer.<o:p></o:p></span></span></div>

owners’ evident lack of due diligence when selling to cash buyers is, however,
starting to concern not only law enforcers, but also the clients and the
financers of shipping. Companies are increasingly asked to make sure that their
business, including their supply chain, does not breach international human
rights standards and does not cause harm to the environment.<o:p></o:p></span></span></div>

green-washing of dirty and dangerous shipbreaking practices that would never be
allowed in the major ship owning countries, the Platform has been able to
counter the arguments of the shipping industry and cash buyers that wish to
exploit workers and the environment for the sake of higher profits. The
proliferation of the misleading Statements of Compliance with the Hong Kong

Far too many of its oilfields are ecological disasters. It has even served as a

have hit upon the tactic of dumping clapped-out vessels in Nigerian waters,
instead of undertaking the costly and complicated process of dismantling them
properly.<o:p></o:p></span></span></div>

about 100. The fact that there are now some 3,000 vessels points to a failure
of the organisations entrusted with the responsibility of keeping the country’s
waters free of wrecks.<o:p></o:p></span></span></div>

exonerated from blame. The agency appears to have paid far too much attention
to the juicier parts of its remit to the detriment of this menace. It cannot
claim ignorance of the growing numbers of shipwrecks littering Nigerian coasts,
nor should it expect praise now that it has belatedly become aware of the
problem now that there are thousands of them.<o:p></o:p></span></span></div>

situation, it is imperative that relevant laws like the Merchant Shipping Act
of 2007 be enforced strictly. This means identifying existing shipwrecks where
possible, tracing their owners and imposing penalties that will cover the cost
of removing them. Greater attention must be paid to the enforcement of
ship-handling and berthing procedures. The navy must be given greater resources
to enable it to do its job more effectively.<o:p></o:p></span></span></div>

comprehensive response aimed at apprehending those who dumped it before they
are able to escape. Rewards for assistance in catching ship-dumpers might turn
apathy into diligence.<o:p></o:p></span></span></div>

to the environment. To address the hazards, the International Maritime
Organization (IMO) adopted the Hong Kong International Convention for the Safe
and Environmentally sound Recycling of Ships.<o:p></o:p></span></span></div>

construction, operation and up to the recycling stage. The Convention
establishes mandatory requirements on shipowners to ensure the safe and
environmentally sound recycling of ships. The Convention also applies to Ship
Recycling Facilities. In general, the Convention requires Facilities “to establish
management systems, procedures and techniques which do not pose health risks to
workers or the population in the vicinity of the Facility and which will
prevent, reduce, minimize and to the extent practicable eliminate adverse
effects on the environment caused by Ship Recycling.”<o:p></o:p></span></span></div>

been ratified by only six nations – Belgium, the Congo, Denmark, France, Norway
and Panama.<o:p></o:p></span></span></div>

is global and the ideal way to ensure a uniform approach to ship recycling is
by an international convention. Uniformity provides certainty and an even
playing field, reducing the financial incentives for practices that endanger
people and the environment. Yet the ratification process can be painfully slow.
The European Union partially filled the gap by regulating ship recycling based
on terms modeled on the Hong Kong Convention. The EU regulations apply to
vessels that are flagged in the EU irrespective of where the recycling takes
place.<o:p></o:p></span></span></div>

EU Ship Recycling Regulation entered into force in 2013. One of the principal
components of the Regulation is the certification of facilities, the so-called
“European List” of approved facilities which meet the requirements of the
Regulation (and consequently would also meet the requirements of the Hong Kong
Convention). The first “European List” of approved facilities was adopted by
the Commission in December 2016. It then included 18 shipyards, all located in
the EU. The list was updated in May 2018 and now includes 21 shipyards.<o:p></o:p></span></span></div>

majority of ships, however, are recycled at sites outside of the EU and mostly
in South Asian sites where the vessels are ‘beached’ and broken up largely by
hand.<o:p></o:p></span></span></div>

ships are sold to buyers who reflag and may then have the financial incentive
to recycle at a site outside of the EU where the vessel is beached and
dismantled in conditions that do not meet the EU standards. On the face of it,
this seems to be legal because the vessel is not flagged in an EU country after
sale – but beware. The Rotterdam District Court held a Dutch company responsible
for breach of the EU Waste Shipment Regulation when the shipowner sold to a
buyer who then sent the vessels for scrapping on beaches in South Asia.<o:p></o:p></span></span></div>

as “waste”, even though they were still seaworthy, certified, insured and

shipowner who sells a vessel at the end of its lifespan to a buyer who then
contracts for shipbreaking at a facility that beaches may not be breaking the
law. Nonetheless, there can be reputational and even financial consequences.
Ships can be easily tracked to their final destination and a non-governmental
organisation (NGO) may ‘name and shame’ the vessel owner despite the fact that
the recycling contract is made by the buyer. Media is quick to pick up such
stories. Increasingly, investors are also shifting away from companies whose
ships end up beached and dismantled in conditions that are harmful to workers and
the environment.<o:p></o:p></span></span></div>

this time be illegal in other circumstances, Owners who sell end of life ships
to buyers knowing that such buyers are likely to dismantle the ship in an
unsafe and environmentally unsound manner, may, at the least, face reputational
risk. At the worst, such sellers may find themselves charged with violation of
waste shipment regulations.<o:p></o:p></span></span></div>

started in Bangladesh in the 1960s. It happened when local people saw that
breaking ships was a bit profitable, and they started getting financing for the
job - there was no environmental or workers’ safety concern at that time,” said
Mohammed Ali Shahin, program officer of NGO Shipbreaking Platform in
Bangladesh. “From 2000, NGOs like us and the media are concerned about the

problems facing the community indulged in the trade is alarming. The shipbreaking
industry witnesses several violations in its daily operations including
environmental pollution, dearth of safety regulations and accidents caused due
to it, worker exploitation, and inadequate waste management facilities.<o:p></o:p></span></span></div>

daily laborers on the shore are predominantly people hailing from the northern
part of Bangladesh, who move down south in search of jobs and a better living.
“These workers come from poverty-stricken areas, and don’t have any chance of
generating income in their villages. The shipbreaking industry is easy to get a
job in, as it does not need any training or certificate - you just go there,
and if you have a person to contact, you can join in,” said Shahin.<o:p></o:p></span></span></div>

people who control the trade are influential people in Bangladesh, and in the
absence of regulations and compliance mechanisms in the industry, turn a blind
eye to the plight of workers. This resulted in various accidents over the
years, till NGOs started intervening in and advocated for safety regulations in
the trade, bringing national and international attention to the industry.<o:p></o:p></span></span></div>

2009, the Bangladeshi court gave a judgment that all ships coming to the yard
should be pre-cleaned of all the debris on-board. Since 2012, the shipbreaking
industry is being regulated by the Bangladesh Ministry of Industry,” said
Shahin.<o:p></o:p></span></span></div>

conditions have considerably improved, Shahin felt that a lot more could be
done to improve the working conditions of laborers. “Accidents are still
happening, and 14 workers have already died this year. Workers are still
working without safety equipment in most of the yards,” he said. However,
Shahin is quick to add that a few yards are actively looking to improve the
situation, by getting certified through national governing bodies for being
compliant with the existing standards.<o:p></o:p></span></span></div>

the government to improve the situation by creating a comprehensive approach to

International Maritime Organization (IMO) and UN Environmental Programme (UNEP)
have initiated laws like the Hong Kong convention that provides guidelines on
ship recycling and regulations on how the ships need to be sent into the yard.
To an extent, the ships coming into the Bangladeshi shore accentuate the
environmental and workers’ health crisis.<o:p></o:p></span></span></div>

coming in from Europe bring in a lot of waste. We try to raise the issue that
it is not our waste and that EU shipping companies should be responsible for
that,” said Shahin. “We send the message that the EU countries and their
shipping companies should contribute to the development of the shipbreaking
industry by bringing waste management facilities and also ensuring safe
recycling of their ships that come into Bangladesh.”<o:p></o:p></span></span></div>

from Bangladesh, countries like India, Pakistan, and China also process ship
scrap, but Beijing is now looking to stop further activities in ship recycling
- in accordance with its new environmental protection laws. China currently
breaks down around 2.5 million tonnes of shipping scrap every year, and it
leaving the market would put additional pressure on the Indian subcontinent.<o:p></o:p></span></span></div>

of this, the only sensible way forward would be for shipping lines to strictly
meet regulations and make sure the community that services scrap does not end

and dangerous shipbreaking practices in Bangladesh have been strongly
criticised both by international and local NGOs for many years. Severe
pollution to the marine environment, hazardous waste dumping, appalling working
conditions causing many severe and fatal accidents, as well as the illegal
exploitation of child workers are amongst the main concerns. Shipbreaking first
grew into an industry in Bangladesh in the 1980s; however, it was not
officially recognised – and thus not regulated – until 2011. In 2009, a land-mark
decision by the Supreme Court ordered the closure of the shipbreaking industry
in Chittagong as none of yards held the necessary environmental clearance to
operate. The yards re-opened based on false certifications and this is
currently still being contested in the Courts.<o:p></o:p></span></span></div>

laws existing in Bangladesh to protect both workers and the environment, these
are poorly implemented due to lack of resources, such as a lack of labour
inspectors, or are deliberately ignored as a result of industry pressure.<o:p></o:p></span></span></div>

vessels are imported with fake certificates claiming that they are free of
hazardous materials, which consequently are not properly detected or safely
removed and disposed of. The World Bank has estimated that between 2010 and
2030 Bangladesh will have imported 79.000 tons of asbestos; 240.000 tons of
PCBs and 69.200 tons of toxic paints that originate from end-of-life ships. The
Chittagong area remains void of storage and treatment facilities for hazardous
wastes and hazardous materials are, as a result, simply dumped or re-sold.<o:p></o:p></span></span></div>

live in unsanitary and improper accommodation. They work long hours without
holidays and usually do not have work contracts. Trade unions are prevented
from effectively organizing the workers. In 2017, the Platform documented the
stories of at least 15 workers who were killed and at least 22 who suffered
severe injuries. The main causes of death are suffocation, fires, falls from
great height or workers crushed by falling parts of the ship. The closest specialised
hospital is too far for emergencies and the injured workers in many cases do
not automatically receive financial support for necessary medical treatment.
The hospital building set up by the Bangladesh Shipbreakers Association is
operated as a private clinic and can only treat minor injuries.<o:p></o:p></span></span></div>

Platform worked with the UK law firm Leigh Day to help a Bangladeshi
shipbreaking worker claim compensation from London-based Zodiac Maritime for
having suffered severe injuries while cutting one of Zodiac’s ships. The case,
which was covered in The Guardian, created quite a stir in the shipping
industry as it was the first time that a South Asian worker sought to hold a
ship owner accountable. In December, the case was resolved through a settlement
to the satisfaction of the worker.<o:p></o:p></span></span></div>

Environmental Lawyers Association (BELA), the Platform member organisation that
has been fighting in the courts against the shipbreaking industry’s violation
of national law since 2003, submitted a new petition on the illegal import of
the Maersk-Odebrecht owned FPSO North Sea Producer. Following an alert issued
by the Platform, the UK Environment Agency appointed an investigator to look
into the illegal export of the ship from the UK to Bangladesh. The Platform has
been providing the UK authorities and the Bangladesh High Court with
information on the illegal sale of the ship, involving also the cash buyer GMS,
the largest trafficker in end-of-life ships to the South Asian beaches. Whilst
Maersk claimed that they had sold the FPSO for further operational use, they
were finally forced to admit that they sold the ship to a shell-company set up
by GMS. At this point, there should be sufficient evidence to demonstrate that
the export from the UK was illegal, and so authorities should proceed with pressing
criminal charges for breach of the EU Waste Shipment Regulation.<o:p></o:p></span></span></div>

investigations have been taking place in the UK, the breaking of the North Sea
Producer was halted in Bangladesh with the judicial intervention of BELA.
Inspections on the content of hazardous materials were carried out and resulted
in a report by the Bangladesh Atomic Agency; according to the report, further
surveys were needed due to the presence of radioactive material on the FPSO.
BELA subsequently succeeded in getting an injunction on the breaking of the
North Sea Producer and is now waiting for the judgement of the High Court,
which is expected before the summer 2018. The case will be followed up on both
sides by the Platform.<o:p></o:p></span></span></div>
